1. Acceptance of Terms

By downloading, installing, or using the Knodo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Knodo is an AI-powered knowledge vault application for iOS that allows users to capture, organize, and expand facts from various sources including books, articles, and podcasts. The App includes AI-powered features for content expansion and smart connections between facts.

3. Account and Eligibility

  • You must be at least 13 years of age to use the App.
  • If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
  • Knodo does not require account creation. The App functions with data stored locally on your device.
  • You are responsible for maintaining the security of your device and access to the App.

4. Free and Premium Tiers

4.1 Free Tier

The free tier provides access to core functionality including saving up to 20 facts, basic search, and categorization. Free tier features may be modified at our discretion.

4.2 Premium Subscription

  • Premium features include unlimited fact capture, AI expansion, voice capture, camera OCR scanning, smart connections, and additional capabilities.
  • Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
  • A free trial period may be offered. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription through your Apple ID settings.

4.3 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels in accordance with Apple's refund policies.

5. User Content

  • Ownership: You retain full ownership of all facts, notes, and content you create or capture within the App ("User Content").
  • Local Storage: Your User Content is stored locally on your device. We do not have access to, control over, or responsibility for your stored content.
  • AI Processing: When you use AI features, the relevant fact text is temporarily transmitted to our AI service provider solely for the purpose of generating expanded content. This text is not stored after processing.
  • Responsibility: You are solely responsible for your User Content. Do not use the App to store sensitive personal information such as passwords, financial account details, or government identification numbers.

6. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App or any part thereof.
  • Use the App's AI features to generate content that is harmful, abusive, defamatory, or violates any applicable law.
  • Attempt to circumvent subscription restrictions, usage limits, or any security measures.
  • Use automated scripts or bots to interact with the App or its AI services.
  • Resell, redistribute, or sublicense the App or any content generated by it.
  • Use the App in any way that could damage, disable, or impair our services.

7. AI-Generated Content

  • Nature of AI Content: AI-generated expansions and connections are provided for informational purposes only. While we strive for accuracy, AI-generated content may contain inaccuracies, omissions, or errors.
  • No Guarantee of Accuracy: We do not guarantee the correctness, completeness, or reliability of any AI-generated content. You should independently verify any information before relying on it.
  • Use at Your Own Risk: You acknowledge that AI-generated content should not be used as a substitute for professional advice in any field including medical, legal, financial, or academic contexts.

8. Intellectual Property

  • The Knodo App, including its design, code, features, and branding, is owned by Knodo and protected by intellectual property laws.
  • The Knodo name, logo, and associated marks are trademarks of Knodo. You may not use these without our prior written consent.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9. Data Loss Disclaimer

Since Knodo stores data locally on your device without cloud synchronization, you acknowledge and accept that:

  • Uninstalling the App will permanently delete all your stored facts and content.
  • Device loss, damage, or failure may result in permanent loss of your data.
  • We are not responsible for any data loss resulting from device issues, App deletion, or any other cause.
  • It is your responsibility to safeguard your device and any content you consider valuable.

10. Service Availability

  • We strive to keep the App available and functional, but we do not guarantee uninterrupted access.
  • AI features require an internet connection and may be temporarily unavailable due to maintenance, outages, or third-party service issues.
  • We reserve the right to modify, suspend, or discontinue any feature or the entire App at any time, with or without notice.
  • Offline features (fact capture, browsing, organization) will continue to work without an internet connection.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KNODO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or Premium subscription in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

13. Indemnification

You agree to indemnify, defend, and hold harmless Knodo and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your User Content, or your violation of these Terms.

14. Termination

  • You may stop using the App at any time by uninstalling it.
  • We may terminate or suspend your access to the App if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately.
  • Sections regarding Limitation of Liability, Disclaimers, Indemnification, and Governing Law survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Knodo operates, without regard to its conflict-of-law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
